Introduction

These Terms & Conditions (“Terms”) govern your access to and use of Spotsavr, a web-based platform that curates and presents verified discount codes in a personalized feed. These Terms constitute a legally binding agreement between you (“you” or “User”) and Spotbookr Inc (“we”, “us”, or “our”).

References to the “Service” include spotsavr.com, the Spotsavr web application accessible at app.spotsavr.com, any associated APIs, email communications, and any future features or platforms operated under the Spotsavr brand by Spotbookr Inc.

1. About Spotsavr & Spotbookr Inc

Spotsavr is a product of Spotbookr Inc, a technology company that builds platforms at the intersection of commerce, content, and data. Spotbookr Inc currently operates or has interests in the following platforms and subsidiaries:

• spotsavr.com, verified discount code discovery platform (this Service)
• spotbookr.com, the parent company platform
• sbkrindex.com, a Spotbookr Inc index and data platform
• Other current and future subsidiaries, platforms, products, and affiliated services operated by Spotbookr Inc (the “Spotbookr Group”)

When these Terms refer to “Spotbookr Inc”, “we”, “us”, or “our”, this refers to Spotbookr Inc and, where the context permits, the Spotbookr Group as a whole.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age. If you are under 18 years of age, you confirm that you have obtained the consent of a parent or legal guardian to use the Service.
• Have the legal capacity to enter into a binding agreement in your jurisdiction.
• Not be barred from receiving services under the laws of your jurisdiction.
• Not have previously had an account terminated by us for violation of these Terms.

By creating an account, you represent and warrant that all of the above conditions are met and that all information you provide is accurate, current, and complete.

3. User Accounts

3.1 Registration

To access certain features of the Service, you must register for an account. You agree to provide a valid email address and to keep your account information accurate and up to date.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately via spotbookr.com if you suspect any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

3.3 One Account Per Person

You may only maintain one active account. Creating multiple accounts to circumvent restrictions, bans, or limitations is strictly prohibited and will result in termination of all associated accounts.

3.4 Account Transfers

You may not transfer, sell, or assign your account or any rights under these Terms to any third party without our express written consent.

4. The Service

4.1 What We Provide

Spotsavr curates and presents verified discount codes in a personalized feed. Codes are quality-scored before being made available to users. Users can browse, copy, save, and interact with codes. Spotsavr also offers a browser extension (“Hermes”) that can automatically detect and apply promo codes on supported retailer checkout pages, and that passively discovers promo codes on any web page you visit. The extension is an optional add-on and is described in detail in Section 5 below.

4.2 Service Availability

We do not guarantee that the Service will be available at all times. We may suspend, modify, or discontinue the Service or any part of it at any time without notice, for any reason, including maintenance, upgrades, or business decisions. We are not liable for any loss resulting from such interruptions.

4.3 Service Changes

We reserve the right to add, modify, or remove features from the Service at any time. We may also introduce new paid tiers or features in the future. The free tier of the Service, if offered at the time of your registration, will remain accessible subject to these Terms unless otherwise communicated.

5. Browser Extension (Hermes)

5.1 What the Extension Does

The Spotsavr browser extension (“Hermes”) is an optional Chrome extension that enhances your shopping experience. When you visit a supported retailer’s checkout page, the extension may:

• Detect that you are on a checkout or cart page;
• Look up available promo codes for that retailer from the Spotsavr database;
• Automatically attempt to apply those codes by interacting with the coupon input field on the page;
• Display an overlay showing the outcome (applied, failed, or no codes available);
• Read your cart contents from the retailer’s cart API (e.g. /cart.js on Shopify stores) to record savings information.

5.1b Code Discovery

In addition to its checkout functionality, the extension passively scans web pages you visit for text that may be a promo code. This includes:

• Banner text, promotional overlays, and popup content on any web page;
• URL query parameters commonly used to carry referral or promo codes (e.g. ?coupon=, ?promo=);
• Pre-filled values in coupon or promotional input fields;
• HTML meta tags that may contain promotional codes.

When a potential code is detected, it is sent to Spotsavr’s servers along with the domain it was found on, the detection source (e.g. “banner”, “url”, “input_field”, “meta_tag”), and a short text snippet for context. Discovered codes are filtered to remove common English words and non-code text before being stored. This data is used to expand the Spotsavr code database and improve code freshness.

When a detected text string is filtered out as a common word rather than a promo code, the surrounding banner or promotional context text (up to 1,000 characters) may still be retained as a “deal sighting”. Deal sightings capture promotional offers that do not require a code — for example, “35% off your first order” or “Free shipping on orders over $50”. This data is stored per retailer domain and used to inform consumers about active promotions and sales, even when no specific promo code is involved. Terms and conditions from the respective retailers always apply.

The code discovery scanner does not capture, read, or transmit the full page content, your browsing history, or any personal information from non-checkout pages. It only extracts short text strings that match promo code patterns, plus the surrounding promotional context for deal sighting purposes as described above.

5.2 Data Collected by the Extension

When the extension is active on a retailer checkout or cart page, it collects and transmits the following information to Spotsavr’s servers for the purpose of savings tracking, service improvement, and personalised reporting. Some data points (marked “if available”) are collected only when the relevant information is present in the page at the time the extension fires:

This data is associated with your Spotsavr account if you are signed in. If you are not signed in, the data is collected anonymously and cannot be linked to a specific user identity. Email address and shipping address are collected only if they are visible in the checkout page DOM at the time the extension fires; they are never read from stored browser autofill data or from pages outside the checkout flow.

5.3 What the Extension Does Not Do

The extension does not:

• Read, store, or transmit your payment card number, CVV, card expiry, or any payment instrument details;
• Capture billing address or payment method information entered in the payment section of checkout;
• Track your general browsing history or the full content of pages you visit. The code discovery scanner (Section 5.1b) extracts only short text strings that match promo code patterns;
• Capture keystrokes, passwords, or any credentials;
• Read browser-stored autofill data, password manager data, or cookies from retailer or third-party domains;
• Capture or transmit full page content, DOM structures, or the text of pages beyond the short code-pattern snippets described in Section 5.1b.

5.4 Extension Permissions

The extension requests the following browser permissions:

• activeTab / tabs — to detect the current page URL and determine if it is a supported checkout page;
• storage — to cache retailer lookup results and extension preferences locally in your browser;
• cookies — to read your Spotsavr session cookie (domain: .spotsavr.com) so the extension can associate savings with your account if you are signed in;
• notifications — to alert you when a new version of the extension is available.

The extension only reads the Spotsavr session cookie. It does not read, access, or transmit cookies from any retailer or other website.

5.5 Auto-Apply Behaviour

The auto-apply feature types codes into the coupon field on your behalf using simulated keyboard input. This is a convenience feature. By installing and using the extension, you consent to this automated interaction with checkout pages you visit. The extension will stop attempting codes as soon as one succeeds or all available codes have been tried. All attempts are silent — you will only see the overlay once the result is known.

5.6 Extension Updates

Because the extension is distributed as a direct download rather than through an app store, updates are not automatic. The extension will notify you via a badge or desktop notification when a new version is available. You are responsible for downloading and installing updates. We recommend keeping the extension up to date to ensure correct and secure operation.

5.7 Removal

You may remove the extension at any time via your browser’s extension management page. Removing the extension does not delete your Spotsavr account or any savings data already recorded. To request deletion of your savings history, contact us at privacy@spotsavr.com.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates any applicable local, national, or international law or regulation.
• Attempt to gain unauthorized access to any part of the Service, its servers, databases, or any system connected to the Service.
• Use automated tools, bots, or crawlers to access, scrape, or extract data from the Service without our prior written consent.
• Submit, upload, or transmit any content that is false, misleading, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Use the Service to send unsolicited communications or spam.
• Engage in any conduct that restricts or inhibits any other user’s use or enjoyment of the Service.
• Introduce any virus, Trojan horse, worm, or other malicious or harmful code into the Service.
• Attempt to reverse engineer, decompile, or disassemble any software forming part of the Service.
• Use the Service for commercial purposes (e.g. reselling codes, operating a competing service) without our express written consent.
• Attempt to manipulate, reverse-engineer, or misuse the browser extension or auto-apply system, including submitting fraudulent apply events or spoofing cart data.

Violation of these acceptable use rules may result in immediate termination of your account and, where applicable, referral to law enforcement.

7. Promo Codes & Auto-Apply

7.1 No Guarantee

Spotsavr curates promo codes from a variety of third-party sources. We make no representation, warranty, or guarantee that:

• Any code displayed on the Service is valid, active, or currently redeemable;
• Any code will result in a discount, saving, or benefit of any kind;
• Any code has been authorized for distribution by the relevant brand or retailer;
• Codes will remain active for any period of time.

Brands may expire, revoke, or modify codes at any time without notice. Your use of any code is entirely at your own discretion and risk. Spotsavr and Spotbookr Inc accept no liability for any failed transactions, declined codes, or loss of savings resulting from your use of codes found on the Service.

7.2 Auto-Apply via the Extension

Where you use the Hermes browser extension, codes may be applied automatically to your cart without manual input. By using the extension, you acknowledge and agree that:

• Automatic code application is provided as a convenience only and does not guarantee a discount or successful transaction;
• The extension may interact with retailer checkout pages on your behalf, including typing into form fields and clicking buttons;
• Spotsavr is not responsible for any unintended checkout behaviour, page errors, or retailer system responses arising from the auto-apply process;
• Reported savings figures are based on data returned by the retailer’s cart API at the time of application and may not reflect final invoice amounts, taxes, or shipping costs;
• Some retailers may flag or void orders where discount codes are applied in an automated fashion — Spotsavr accepts no liability for such outcomes.

8. Intellectual Property

8.1 Our IP

All content, software, design, trademarks, logos, brand names, databases, and other materials forming part of the Service (“Our Content”) are owned by or licensed to Spotbookr Inc. Nothing in these Terms transfers any ownership of Our Content to you.

8.2 Your Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purposes. This licence does not include any right to sublicense, reproduce, distribute, modify, publicly display, or create derivative works from Our Content.

8.3 Feedback

If you submit feedback, suggestions, or ideas about the Service (“Feedback”), you grant Spotbookr Inc a perpetual, irrevocable, worldwide, royalty-free licence to use that Feedback for any purpose, including incorporating it into the Service, without any obligation to you.

9. User-Generated Content

Where the Service permits you to submit content (such as profile information, code reports, or reviews), you grant Spotbookr Inc a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display such content in connection with operating and improving the Service. You represent that you have the right to grant this licence and that your content does not violate any third-party rights or applicable law.

10. Data & Privacy

Your use of the Service involves the collection and processing of personal data by Spotbookr Inc. By using the Service, you agree to our Data Policy and Cookie Policy, both of which are incorporated into these Terms by reference and form part of this agreement.

In summary, and without limiting the full scope of those policies: your data may be collected, stored, processed, and used for purposes including service delivery, personalisation, product improvement, security, and research and technical development across the Spotbookr Group, including spotbookr.com, sbkrindex.com, and other Spotbookr Inc subsidiaries.

If you use the Hermes browser extension, additional data is collected as described in Section 5.2 above. This data includes retailer domain, codes applied, cart contents (product names, variants, sizes, prices, savings), and your Spotsavr session identifier. This data is used to power your personal savings dashboard, improve code quality rankings, and conduct analytics on discount performance across retailers. It is not sold to third parties. See our Data Policy for full details on retention periods and your rights.

10.1 Email Tracking

Spotsavr sends transactional and notification emails (e.g. new code discovery alerts, weekly recap summaries). These emails may contain:

• Tracking pixel: A small, invisible image (1×1 pixel) loaded from Spotsavr’s servers when you open the email. This records that the email was opened, along with your IP address, user agent, and the time of the open event.
• Click tracking: Links in the email may be routed through a Spotsavr redirect endpoint before reaching their destination. This records that you clicked a specific link, along with your IP address and user agent.

This data is used to measure email engagement, improve email content and frequency, and ensure deliverability. It is not shared with third parties. You can avoid tracking by disabling image loading in your email client and by navigating directly to Spotsavr rather than clicking email links.

11. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Spotbookr Inc and each of its current and future subsidiaries, affiliates, related entities, officers, directors, shareholders, employees, contractors, agents, licensors, and successors, including but not limited to the operators of spotsavr.com, spotbookr.com, sbkrindex.com, and all other platforms within the Spotbookr Group, from and against any and all claims, actions, proceedings, demands, damages, obligations, losses, settlements, judgments, liabilities, costs, and expenses (including reasonable legal fees and disbursements) arising out of or relating to:

• Your access to or use of the Service, or any action taken through your account;
• Your breach of any provision of these Terms or any policy incorporated herein;
• Your violation of any applicable law, regulation, or third-party right, including but not limited to intellectual property rights, privacy rights, or consumer protection laws;
• Any content, data, or material you submit to or through the Service;
• Any dispute between you and any third party (including brands or other users) arising from your use of the Service;
• Any claim that your use of the Service caused damage or loss to a third party;
• Your misuse of any promo code, including using a code in breach of a brand’s terms and conditions.

We reserve the right, at your expense, to assume exclusive control of any matter for which you are required to indemnify us. You agree to cooperate fully with our defence of any such claim. This indemnification obligation survives termination of these Terms and your use of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Spotbookr Inc and all entities within the Spotbookr Group shall not be liable for any of the following, whether based in contract, tort, negligence, strict liability, or otherwise:

• Indirect, incidental, consequential, special, or punitive damages;
• Loss of profits, revenue, business, goodwill, data, or anticipated savings;
• Damages resulting from your inability to access or use the Service;
• Damages resulting from any promo code failing to work or being invalid;
• Damages resulting from any unauthorized access to your account;
• Damages resulting from any third-party content, services, or links accessible through the Service.

Our total cumulative liability to you for any and all claims arising from or related to these Terms or your use of the Service shall not exceed the greater of: (a) the total amount paid by you to Spotbookr Inc in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) USD $25.00.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Spotbookr Inc expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Service will be uninterrupted, error-free, or secure;
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of any content, including promo codes;
• Any warranty that defects will be corrected.

14. Termination

14.1 By Us

We may suspend or permanently terminate your access to the Service at any time, with or without notice, and with or without cause, at our sole discretion. Grounds may include, but are not limited to, breach of these Terms, fraudulent or abusive behavior, or cessation of the Service.

14.2 By You

You may delete your account at any time through the account settings within the Service. Deletion of your account constitutes termination of these Terms with respect to you. Certain provisions of these Terms will survive termination, including Sections 8 (Intellectual Property), 11 (Indemnification), 12 (Limitation of Liability), 13 (Disclaimer of Warranties), and 17 (Governing Law).

14.3 Effect of Termination

Upon termination, your right to access and use the Service immediately ceases. We may retain certain data as described in our Data Policy, including data needed to fulfil legal obligations or to enforce our rights.

15. Third-Party Links & Services

The Service may contain links to third-party websites, brand sites, and other external platforms. These links are provided for convenience only. Spotbookr Inc does not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is entirely at your own risk and subject to their own terms and policies.

The Hermes browser extension interacts with third-party retailer websites (e.g. Shopify-powered stores) on your behalf when you use the auto-apply feature. These retailers are independent third parties. Spotsavr is not affiliated with, endorsed by, or responsible for any retailer’s website, checkout process, pricing, fulfilment, or customer service. Any purchase you make through a retailer is a transaction solely between you and that retailer.

16. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, including adding or removing features, changing pricing, or introducing new products. We will endeavor to provide reasonable notice of material changes where practicable, but are under no obligation to do so.

17. Governing Law & Disputes

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the jurisdiction in which Spotbookr Inc is incorporated, without regard to its conflict of law provisions.

You agree that any dispute arising from your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be referred to binding arbitration or the appropriate courts of the governing jurisdiction, at our election.

You agree to bring any claim against Spotbookr Inc in your individual capacity only, and not as a plaintiff or class member in any purported class action or representative proceeding.

18. Changes to These Terms

We may revise these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we will endeavor to notify you via the email address associated with your account or via a prominent notice within the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.
